Extensions to Commercial and Residential Evictions
The ban on commercial and residential evictions has now been extended by 3 months to 30 June 2021.
This is to ensure that businesses that had to cease trading completely are provided with extra support as they begin to reopen. This decision is intended to help those that were worst affected by the pandemic, such as bars and restaurants when the hospitality sector reopens no earlier than 17 May 2021.
The government has made it clear that if businesses are able to pay all or some of their rent, then they should continue to do so.
Enforcing residential evictions
The bailiff enforced eviction bans have been extended to 31 May 2021 and only the most serious cases can result in a tenant/licensee eviction. The requirement for landlords to provide 6-month notice periods to tenants before they can evict will also be extended to at least 31 May 2021. This is to ensure that residents in the private and social sectors are given sufficient time to find alternative accommodation.
Landlords and licensors are still able to serve notices and apply to the court for a possession order, once obtained, it’s the physical eviction of the tenants/licenses that is not available for most cases.
Court arrangements and rules that were introduced in September have been extended to the end of July 2021 to ensure that most serious cases such as anti-social behaviour and fraud are prioritised and landlord must still provide the court with information on how the pandemic has impacted their tenants.
